nowhere did Jesus say or imply Nicodemus was born again and in fact Jesus pointed out his need to be born again. Nic did not know what the new birth even was and Jesus had to explain it to him.
Way to TWIST scripture to fit into your self willed pharisaical self righteous and fatalistic/determinist theology.
no one was born again until Pentecost which Jesus and the Apostles taught in the New Testament.

Nicodemus SHOULD have known. He didn't know but he should have known. We can know this because the narrative details it.

Part of the condemnation that existed in the teachings of Jesus toward those who heard was the fact they should have known what Jesus was telling them. Not all of what Jesus said.... but much if not most of what Jesus said.
They simply did not recognize them because of their unbelief. There is much ignorance in unbelief. Believing is accepting God for what He says even if you don't currently understand it. Believing requires that you not stay where you are at in understanding but empowers you to seek God. Those that seek...... find. It is the duty of all men to seek God.
